September 10, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2000 hours with the Pledge of Allegiance. Present were Sachar, Jarrett Miller, David Henderson, Gary Truitt and Robert Deist. HEARING: ORDINANCE #1-2002, AN AMENDMENT TO THE SUBDIVISION ORDINANCE TO ELIMINATE FRONT TO DEPTH RATIO, 2001 HOURS Henderson – the Planning Commission recommends reinstating the 11/1 ratio. Sachar – if we eliminate a ratio entirely, you won't have to worry if a parcel complies. We're pretty well blocked off in the Township. No additional comments were made. Hearing was closed at 2005 hours. Gary Truitt – if I buy property, another lot, what happens to my assessment? Is the assessment set up for 22 owners? Henderson – should the property be already assessed, it would be a transfer, if the person already has paid or will pay the assessment on it. Suppose he wants to buy from his neighbor, it is already assessed to the current owner. If you buy it the current owner has to pay the assessment. If you buy it before the assessment goes into effect, you have to pay the assessment. When there is a known cost on property, it would be paid for at the closing. If you sold to a total stranger, it would be assessed and you would pay through the selling price of the lot. Discussion. VISITORS/PUBLIC COMMENT Robert and Charles Deist Conditional Use Request – Robert and Charles Deist, 9863 Eureka Road, are requesting a conditional use permit for side yard relief of the 30 ft. setback. They have an existing building built at a 15 ft. side yard when the side yard regulation was 15 feet. They would like to add an addition on to each end of the building in line with the 15 ft. side yard. Miller moved to set the Deist conditional use hearing for October 8th at 8 p.m. Sachar seconded. Carried. MINUTES Miller moved to approve the minutes of 8/29/02 as presented. Henderson seconded. Carried. REPORTS Superintendent – Dave reported that the crew was off last week. Larry is off this week to work at the Albion Fair. Rick C. is working on the 1-ton, Rick J. is mowing, and Dave has been doing paperwork. The roads are all wash boarding. Without rain it will be a dust bowl if grading is done. Not much brine is available for use. There have been no reports of low water well levels made to the Township. Agility – Dave will talk to PennDOT about cleaning under our guide rails. Diesel Engine, Eureka Road #4 Paving Project, Light at Crane and Rt. 98, Falls Road Bridge #1 – nothing. FINANCIAL AND TAXES Bills – included in the bill list is the Russell Standard invoice for EU4. The pipe special ordered for the Farmer dry hydrant will be held. Hopefully the fire department can convince Cindy that a hydrant is needed at her pond. Henderson moved to pay the bills as listed, holding the Corey and Associates bill. Bills totaled $1,450.69 general fund; $1,325.51 state fund; $5,230.56 EIT fund; $1,994.93 fire dept. fund; $2,030.57 equipment fund and $97,749.20 permanent improvement fund. Miller seconded. Carried. Payroll – none. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes – discussion on the ingress/egress shown on the Mathewson Mylar on the lot owned by Terry and Jane Mathewson Everett. Update Comprehensive Plan – the Board will review our Planning Commission's comments concerning the Regional Planning Commission By- Laws and the letter from Edinboro Borough to their attorney. Industrial Park/KOZ – Dave reported on a meeting to be held on October 17th at 1 p.m. at EUP to discuss the next step for possibly developing an arts incubator. Dave feels that this is our best opportunity for the KOZ to be developed. Storage Trailers, Census Undercount, OTM Bulk Sewer, Maintenance Agreement for SFTS, Repairs to Francis Cemetery – nothing. History Grant – the graduate student, Dave Neal, is ready to help with the interviews. We have several residents that we would like to interview before the grant begins in November. Junk Cars – a drive by will be done in the fall. Recycle Survey – forms are still coming back. Ordinance #2-2002 – an Emergency Management Agency needs to be established within the Township. Miller moved to advertise a hearing for Ordinance #2-2002 and set the hearing date for October 24, 2002 at 8 a.m. Henderson seconded. Carried. SOLICITOR Animal Density Ordinance, Western Trail – nothing. Verizon – discussion is needed. OLD BUSINESS Hearing/Guiderail Damage at Falls and Francis – hearing was rescheduled for September 27th at 9:30 a.m. in front of D.J. Stuck. Political Signs – nothing. Incentives for Fire Departments – the State legislature is taking up the issue of incentives for volunteer fire persons. Franklin Township was the first to draw up a resolution on this issue that was upheld by ECATO and PSATS. Ordinance #1-2002 – Henderson moved to adopt Ordinance #1-2002, an amendment to the Subdivision Ordinance that eliminates the front to depth ratio. Miller seconded. Carried. CCC Meetings – meetings will be held to discuss economic development. NEW BUSINESS Appoint Auditor to Replace Jim Pfadt – Mr. Pfadt winters in the south and is unavailable to make the January meeting. The Supervisors accepted his resignation with regret. Henderson moved to appoint Gary Truitt to the remaining term. Miller seconded. Carried. Mr. Truitt accepted the appointment. Act 100/Open Records Policy – each municipality within the State must adopt an open records policy. Work will begin on drafting a policy for the Township.
