October 8, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2020 hours. Present were Sachar, Jarrett Miller, David Henderson, Gary Truitt, Dan Parker, Robert Deist and Attorney George Schroeck. The Chairman announced that an executive session was held on September 26, 2002 to discuss legal matters. It was also announced that an executive session was held from 2000 hours to 2020 hours this date to discuss Western Trail. CONDITIONAL USE HEARING/ROBERT AND CHARLES DEIST, 9863 EUREKA ROAD FOR SIDE YARD RELIEF—2022 HOURS The Deists would like to add an addition to each end of an existing pole building that is 15 feet from the neighboring property line. The building was constructed when the side yard requirement was 15 feet. The additions will maintain a 15- foot side yard. Chairman asked for comments from those present, no comments made. Sachar moved to grant the Deist conditional use request for side yard relief to 15 feet. Miller seconded. Carried. Mr. Deist left the meeting at 2024 hours. VISITORS/PUBLIC COMMENT None. SOLICITOR Western Trail/G. Antolik – John read a proposed resolution on the conditions for accepting Western Trail as a Township road that includes wording on the paving of the cul-de-sac. Miller moved to accept RESOLUTION #6-02 and adopt Western Trail as a Township road upon the paving of the cul-de-sac. Henderson seconded. Carried. See attached Resolution #6-02. Verizon – a letter was sent. Ordinance/Animal Density – waiting for information from PSATS. Attorney Schroeck left the meeting at 2029 hours. MINUTES Henderson moved to accept the minutes of 9/26/02 as presented. Miller seconded. Carried. REPORTS Superintendent – Dave reported that grading and brining have been done. Brine continues to be in short supply. Township is looking for an employee. Agility, Diesel Engine, Light at Crane and Route 98, Falls Road Bridge #1 – nothing. Eureka Road #4 Paving Project – a nuclear gauge test was done on 24 spots on the road. There were no repeatable bad tests. Most of the readings were acceptable. That section was graded today and will be graded and rolled the next time. Dave suggested fogging it with MC-70 to hold the stone in place. This should help to prevent stone loss due to snowplowing. Estimated cost is $4,000 to fog the whole section 22 feet wide. Fogging is a light coat of oil instead of the heavier coat that is done in the summer. Sachar – I'd be in favor of doing it to save the stone. Henderson – we will grade, roll and shoot it in November. Capital Projects and Budget – Dave asked for input from each Supervisor and suggested a work session to discuss the matter before the next meeting. Will meet on October 11th before the meeting with Dave Skellie, Erie County Planning Director. FINANCIAL AND TAXES Bills – discussion on various bills. Miller moved to pay the bills as listed totaling $2,432.34 general fund; $360.59 fire dept. fund; $2,030.57 equipment fund. Henderson seconded. Carried. Payroll – Miller moved to approve payroll #21-02 as presented. Sachar seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes – reviewed. Regional Planning Commission – new draft was received. Still on hold for a decision from the State on the makeup of the commission. History Grant – we will purchase a video camera as soon as we receive the go ahead from the State. OTM Bulk Sewer Agreement – Washington Township has not received any word from OTM on this matter. Industrial Park/KOZ, Storage Trailers, Census Undercount, Maintenance Agreement for SFTFs, Repairs to Francis Cemetery, Junk Cars, Ordinance #2-02/EOP – nothing. Recycle Survey – will compile the information we received. David and Bonnie Bernhardt Mylar – Mylar shows a flag lot with 170 ft. of frontage at 10721 Eureka Road opening to a 338.66 ft. width at the rear. The parcel will have 14.0534 acres and has an existing garage and mobile home. The residue has an existing house and outbuildings with 41.95 acres and approximately 730 ft. of frontage. Sachar moved to accept the Bernhardt Mylar as presented. Miller seconded. Carried. Shooting Range Complaint – a complaint was received from a neighbor on the noise from the shooting range. CamTech is in charge of the grounds (formerly ESTA) until the end of the year when the County is to take it over. CamTech was contacted and their instructor in charge of the range said that he was not aware that the range was to be constructed with baffles to help muffle the noise. He also said that he would contact the County about the issue when they take it over. The grounds are to be closed for the winter on October 31st. The Township is to receive a letter stating that the baffles will be constructed and a schedule of shoots is to be enclosed. Edinboro Lake Watershed Association – Jarrett will be our representative. No meetings have been held as yet. OLD BUSINESS Guide Rail Damage Hearing/Robert Phillips – the Township prevailed. Mr. Phillips did not dispute that he hit the guide rail. He agreed to submit the claim to his insurance company and if they don't pay it he agreed to make payments to the District Justice. Political Signs – nothing. CCC Meetings – ongoing. Open Records Policy – PSATS will supply a model policy. Elk Creek Boundary Road Agreement – they are not interested in our suggestion. NEW BUSINESS None. CORRRESPONDENCE Meeting with County Planning Director, Dave Skellie – meeting will be here on October 11th at 8 a.m. Terrorism Workshop – November 19th. Washington Township Memorial Park Letter of Support – the letter of support will be in the form of a Resolution. They are applying for a grant for the extension of their park that is located next to their municipal building. See attached RESOLUTION #7-02.
