December 10, 2002 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2000 hours with the Pledge of Allegiance. Present were Sachar, Jarrett Miller, David Henderson, Dale Kallenbach, George Antolik, Gary Truitt and Earl Koon/Russell Standard. HEARING: ORDINANCE #3-02, ACCEPTANCE OF WESTERN TRAIL DRIVE AS A TOWNSHIP ROAD—8:00PM Sachar asked for comments from those present. No comments. Henderson moved to adopt Ordinance #3-02, Acceptance of Western Trail Drive as a Township road. Miller seconded. Carried. BID OPENING: PAVING EUREKA ROAD #4, FRANCIS CEMETERY DRIVEWAY—8:05 PM One bid was received. Russell Standard Corp. bid $99,985 for Eureka Road #4 and $21,995 for Francis Cemetery driveway for a total of $121,980. Henderson – the Eureka portion is $2,985 above the budget we established. We need to review the bid and can award it on 12/26/02. Earl Koon – the bid specs were higher than the estimate given. BID OPENING: GENERAL TRUCKING—8:05 PM Two bids were received. 1. Frank Tucci Inc. bid $48/hr for Mack dump trucks and $75/hr for a loader. 2. Russell Standard Corp. bid $46/hr for International dump trucks and $50/hr for a loader. Henderson – the trucking has to cover the cinder hauling next Monday. Henderson moved to award the trucking bid to Russell Standard Corp. Miller seconded. Carried. VISITORS/PUBLIC COMMENT Dale Kallenbach – why not try tar and chip on some of the roads without the elaborate ditching, fabric etc. I think it would hold up a year and patch it the second year. I think people will go for it instead of oil each year. Hawthorne Ridge and Gudgeonville have just tar and chip. If it holds up on them, it will hold up. You would need a good base under the road. Russell Standard agrees with me. Grading with planes isn't used anymore. Most just use a York rake behind the grader. If you pay $3.25-$3.50 a foot and budget two years, you can eliminate grading and ditching problems. Property values will come up. Henderson – we pay for recoating Gudgeonville and Hawthorne Ridge. The plan I gave you is directly from Fairview. If we put it down and were forced to redo it because of a bad spring, we're soon out of money. Kallenbach – get people to put up money for two years. They might be receptive to this instead of oil; try one or two roads. Oil holds up over winter and into the spring. It could be an overall benefit to the Township. Think about it and ask the residents and look into using just the York rake instead of planes. Sachar – once you get the roads all paved, you don't need planes. George Antolik – this is the only Township that makes people pay for their own paving. The roads need a good base to begin with. Henderson – that's true, most other counties just decide to pave a road and assess the residents, no questions asked. The problem with tar and chip is that we could get into a situation where it falls apart and there is no money to fix it. Sachar – none of these roads have a good base. The savings is intangible. Henderson – you would have to use a prime coat and a triple seal; the second year you'd recoat and then every three years after you'd use a single seal coat. You can say there would be less ditching because of less erosion. We ditch every third year and use the Tiger ditcher every year. Take a good close look at those figures. Green Township floated a bond and did the whole township and raised taxes until it was paid. Dale Kallenbach left the meeting at 2030 hours. MINUTES Miller moved to approve the minutes of 11/21/02 as presented. Henderson seconded. Carried. REPORTS Superintendent – the crew has run around 10 plow rounds so far. The hard pack will turn to ice if it rains. Will use anti-skid tomorrow. Agility, Sale of Diesel Engine, Intersection Lighting, Falls Road Bridge #1 – nothing. CDL Driving Hours – Dave reported that PSATS recommends adopting a policy and resolution on driving hours during an emergency situation, like a snowstorm. Municipal CDL's are exempt from driving hours under emergency situations. We need to determine what an emergency is in order to establish the criteria and we need to establish a policy. Cinders – Dave reported that our week of cinders comes up next week. They will be used in the spring on slimy roads. FINANCIAL AND TAXES Bills – Miller moved to approve the bill list for payment totaling $20,376.28 general fund; $4,103.45 permanent improvement fund and $2,030.67 equipment fund plus year end transfers. Henderson seconded. Carried. Payroll – Miller moved to approve payroll #25-02 as presented. Henderson seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Update Comprehensive Plan, Industrial Park/KOZ, Storage Trailers, Census Undercount, OTM Bulk Sewer, Maintenance Agreement for SFTF, Recycle Survey, Ordinance #2-02/EMA, Edinboro Lake Watershed Association – nothing. History Grant – the video camera will be purchased tomorrow. Discussion on the next grant phase. Five thousand dollars of the next phase is match free. We applied for $12,500 that includes a $3,750 match for the Township and a $3,750 match for EUP. We sent out the letters to those who will be interviewed. Dianne Horn will call the people for their consent. The graduate assistant will call them to schedule their actual interview. Francis Cemetery Grant – Dave said that he would like to target July 4th for completion of the project and a dedication ceremony for the driveway. Junk Cars – drive-by was rescheduled for December 28th at 9 a.m. Shooting Range – Dave will call the County EMA about the range. Outside Furnace – discussion on an outside wood stove on Fry Road. Concern is that it is too close to the road. Under the Zoning Ordinance it was determined that it is not a building and is exempt from setbacks. Platz Mylar – not back from the County. SOLICITOR Animal Density – the law that would have eliminated townships from regulating farming died in the House. Henderson – the Planning Commission didn't address our concerns because of S.B. #1413. This bill will most likely be reintroduced. Miller – table it until we see if the House picks it back up again. Verizon, Verizon Cable Damage – nothing. Western Trail – done. OLD BUSINESS Political Signs – waiting. Open Records Policy – policy was read aloud. Miller moved to adopt the Open Records Policy. Henderson seconded. Carried. Benefits Plan Update – some of the employees are interested in a pension plan. Discussion on a simple IRA that is a payroll sponsored plan and requires a small contribution from the Township. The employee can then contribute what he wants. An IRA is something the employee can take with him if he leaves. Also discussed was a regular IRA with no contribution from the Township. On a simple IRA you still pay social security and Medicare taxes. NEW BUSINESS RESOLUTION #8-02 BE IT HEREBY RESOLVED that the Board of Supervisors of Franklin Township authorizes the signing of all necessary documents by all required Township officials to secure a tax anticipation note from PNC Bank for 2003 in the amount of $50,000. Adopted this 10th day of December 2002. Henderson moved to adopt Resolution #8-02. Miller seconded. Carried. RESOLUTION #9-02 BE IT HEREBY RESOLVED that the Board of Supervisors of Franklin Township sets the tax levy for 2003 at 1.3 mills: 0.80 mills general fund; 0.15 mills fire department fund; 0.15 mills equipment fund and 0.20 mills permanent improvement fund. RESOLUTION #10-02 BE IT HEREBY RESOLVED that the Board of Supervisors of Franklin Township adopts the tentative budget for 2003 as advertised totaling $448,778 (includes one time large revenues); $327,651 (excludes one time large revenues). PSATS Legal Assistance Fund – the Township contributes each year when we renew our dues. Miller moved to continue to support the fund. Henderson seconded. Carried.
