April 28, 2005 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0815 hours with the Pledge of Allegiance. Present were Sachar and David Henderson. Jarrett Miller was absent due to illness. HEARING ORDINANCE #1-05/EMERGENCY MANAGEMENT AGENCY, 0815 HOURS With no one present to comment, Sachar closed the hearing at 0816 hours. VISITORS/PUBLIC COMMENT No visitors present. MINUTES Henderson moved to approve the minutes of 4/12/05 as presented. Sachar seconded. Carried. REPORTS Roadmaster – Dave reported that the crew is changing the equipment over from winter to spring. Equipment repairs are being made. The oil leak on the Oshkosh is being repaired and when the major projects for the year are completed, it will be taken to New York for additional repairs. The joints on the Tiger mower arm are being rebuilt. All the roads have been graded and stone is being placed in bad areas. Agility – Dave reported that he met with Lew Hamilton of PennDOT. We will mow again for them this year. Falls Road Bridge #1 – no word from our engineer. The County Emergency Liquid Fuels committee will meet on May 19th. CDL Driving Hours, Equipment Repairs, Stop Sign Maintenance, Anti-Skid Building – nothing new to report. Fairview Twp. 1988 4900 Single-Axle Dump – Board decided they are not interested in the truck. Grant for Snowplow Equipment – discussion on a grant for shared snowplow equipment. Sachar – it’s worth pursuing. We may be able to work out something with Elk Creek Twp. more than with Washington Twp. Henderson – Terry Carcella at Washington Twp. is the one who brought it to our attention. Discussion. FINANCIAL AND TAXES Bills – discussion on various bills. Sachar moved to pay the bills as listed totaling $4,950.10 general fund; $9708.70 state fund; $1,514.00 fire dept. fund. Henderson seconded. Carried. Payroll – Henderson moved to approve payroll #8-05 as presented. Sachar seconded. Carried. EMS Tax – nothing. Employee Benefits Credit Hours – Dave suggested that we determine credit by hours worked, so many hours equals a year’s credit. Sachar – 1,600 hours maybe. Figure the average work year, time snowplowing. Attorney George Schroeck arrived at 0835 hours. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Industrial Park/KOZ, Storage Trailers, SFTF, Recycling, Edinboro Lake Watershed – nothing. Irwin Mylar – the Mylar shows three lots at 10280 Route 98. Lot 1 has 23.109 net acres with 400 ft. of frontage. Lot 2 is irregular and has 16.076 net acres, a house and barn and 631.50 ft. of frontage. Lot 3 is the residue with 66.519 net acres with 628.26 ft. of frontage. Sachar moved to approve the Irwin Mylar as presented. Henderson seconded. Carried. Mylar was signed. Regional Planning – a meeting was held last week. Nothing to report. History Grant – Dave reported that he called the video person at EUP to encourage him so that the project can be completed. Ordinance Compliance – the Board conducted a spring drive-by of the Township. Letters of violation will be sent. A letter of inquiry will be sent to Northwestern RECA for poles too close to the road. Discussion on home-occupations by right. There can be no outward appearance of a home-occupation. Discussion on violation notices. Henderson – it is the homeowner’s responsibility to come to the Township to request a conditional use if he has a home-occupation with outward signs of a business. I don’t think we should issue a building permit until a property is brought into compliance. We could hold the occupancy permit. Shooting Range – the shooting schedule was received from Lt. Fetterman and mailed to the residents who signed the petition. SOLICITOR MDIA Contract – the agreement with MDIA was reviewed. The optional wording on who collects the fees was crossed out and initialed. Agreement will be sent to MDIA for their signatures. Vittorio Lien – the NIDMA meeting is tonight, 4/28/05. OLD BUSINESS Internet Survey, PA One Call – nothing. ORDINANCE #1-05 EMERGENCY MANAGEMENT AGENCY An Ordinance establishing an Emergency Management Agency, Emergency Management Advisory Council and Emergency Management Coordinator within Franklin Township, Erie County, Pennsylvania. Sachar moved to adopt Ordinance #1-05 as presented. Henderson seconded. Carried. Meeting with Representative Matthew Good – Dave reported that Rep. Good was looking for our financial needs. We listed cross pipes, anti-skid building and Internet access. Good said he would intercede with Verizon on DSL. Power Outage – Dave reported that he is working on letters to be sent to the PUC and Northwestern RECA. NEW BUSINESS Walsh Equipment Show – Sachar moved to authorize the Roadmaster and employees to attend the show on May 24th. Henderson seconded. Carried. County Executive’s Fax on Gaming Revenue – the County Executive says not to give away the citizen’s money to MTR Gaming. Discussion. CORRESPONDENCE ACRE Memo from PSATS – discussion on factory farms. Henderson – the issue is how do we want to advise our legislators on this issue. This proposal is to allow a court of general jurisdiction to overrule the local municipality’s authority over zoning. The review board is now a binding arbitrator. Discussion. ECATO Yearbook Dinner – Dave will attend. Will contact Jarrett to see if he wants to go.
