August 9, 2005 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 2008 hours with the Pledge of Allegiance. Present were Sachar, David Henderson and Gary Truitt. Supervisor Jarrett Miller was out of town. VISITORS/PUBLIC COMMENT No comments. MINUTES Henderson moved to approve the minutes of 7/28/05 as presented. Sachar seconded. Carried. REPORTS Roadmaster – Dave reported that some grading has been done. Discussion on wash boarding of the road surface. Some Athey ditching was done, approximately 2 miles, and the Athey ran fine. Some pipes have been installed and waterways have been ditched and mowed. Since it’s repair, the mower has been working well. Discussion on the State’s tail ditches. Agility, CDL Driving Hours, Equipment Repair, Dirt and Gravel Road Grant Application, Francis Road Big Pipe, Grader Agreement with Washington Township – nothing new to report. Falls Road Bridge #1 – Mark Corey reports that he is very close to having all needed approvals. If construction can begin in September, the bridge should be done, except for the asphalt, by Thanksgiving. Corey is targeting August 25th for the bid opening. Blocks for Anti-Skid Building – PennDOT is working on prices for the blocks. FINANCIAL AND TAXES Bills – discussion on various bills. Sachar moved to approve the bill list for payment totaling $6,224.19 general fund and $983.63 equipment fund. Henderson seconded. Carried. Payroll – Henderson moved to approve payroll #16-05 as presented. Sachar seconded. Carried. Clean and Green Reassessments – ECATO took no action on this at their last meeting. Dave said that he would ask them again if they want to take a position on this issue. Procurement Cards, Employee Benefits Credit – nothing new to report. EMS Tax – Dave reported that the State Legislature is considering several bills on this matter. The name would be changed to Municipal Services Tax and the exempt income threshold would be set at $12,000. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes – reviewed. Regional Planning Commission/Update Comprehensive Plan – our hearing date for the comprehensive plan will be September 13, 2005 at 8 p.m. County Planning sent their review of the plan. Industrial Park/KOZ/KIZ – there will be a meeting coming up in August with PennDOT and State representatives to discuss the Washington Township proposal, possibly in the Erie office of DCED, arrangements to be finalized. Storage Trailers – the issue was revisited at the last Planning Commission meeting. Dave will rewrite the proposed ordinance. History Grant – waiting for a DVD update. Ordinance Review/Zachary Smith, 8244 Crane Road – the matter is still under investigation by the Zoning Officer. Recycling, Edinboro Lake Watershed, SFTF – nothing. Shooting Range – a letter was received from Lt. Fetterman concerning the upcoming schedule. No response as yet from Joe Weindorf to our recent letter. Attorney George Schroeck arrived at 2030 hours. Junk Yard/Swanson Property at 9648 Mohawk Road – a signed complaint under the Nuisance Ordinance was received. Photos taken of the property on various dates were reviewed. Executive session to discuss this issue began at 2038 hours. Executive session ended at 2050 hours. Sachar moved to authorize the Solicitor and the Township Code Enforcement/Zoning Officer to file and post the necessary paperwork and notices required to proceed with a Nuisance Ordinance hearing and to charge the owner with a violation of the Junk Yard Ordinance. Henderson seconded. Carried. Denny’s Bar and Banquet Noise Complaint – at a recently held Bike Night, several residents filed noise complaints with PSP. PSP told them to contact the Board of Supervisors. Henderson – we need a good noise ordinance. I will get a copy from EPA that we can review. Discussion. Schroeck – it was up to the PSP to do something. That was disorderly conduct. SOLICITOR Vittorio Judgment – hearing date is set for 9/22/05 at 1:30 p.m. with District Justice Stuck-Lewis. Discussion.
