August 25, 2005 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0810 hours with the Pledge of Allegiance. Present were Sachar, David Henderson, Dan Netzler and George Welka/Welka’s Disposal. VISITORS/PUBLIC COMMENT Discussion was held on current problems with recycling pick up. Henderson – the Ordinance says if you are a tag customer and have a tagged bag, your recyclables are free in any amount when set out with the tagged bag. George Welka – if you are using tags, it’s one bag of recyclables per tagged bag. Customers are using one tagged bag and many bags of recyclables. Henderson – we want to provide the incentive to recycle and not be a deterrent to it. If one bag of regular garbage is set out, you can set out any amount of recyclables. Effective recyclers have far fewer tagged bags and lots of recycling. Jarrett Miller arrived at 0815 hours. Henderson – you keep changing the rules. Now you are limiting bags of recyclables. We’re working off the Ordinance that you in essence created. If the price isn’t right, adjust the price. You are a fair person. Sachar – my wife called your office and the lady that answered the phone said only one tagged bag per bag of recycling. We even had recycle tags on our recycling along with regular tagged bags and you didn’t take them. Welka – that was a screw up on our part. Sachar – we want to encourage recycling. Whoever answers your phone needs to know the rules. Henderson – if you limit the number of bags of recycling per tagged bag, people won’t recycle. If you say one to one, you’ll destroy the whole system. Welka – recycling costs money, it’s a losing proposition for us. Sachar – do you have a separate truck for recycling? Welka – no they separate it out when they get back to the big truck. If you have a problem, call and we’ll get it straightened out. Sachar – whatever we decide, we need to encourage recycling. Track those who you feel are playing the system and get back to us. Mr. Welka left the meeting at 0835 hours. Dan Netzler stated that he is setting up a commercial hunting preserve and has already applied for the permit for raising game birds. The Township sent a letter saying that there are no regulations against raising game birds. Now the State wants a letter from the Township saying that there are no regulations against hunting preserves. Henderson – a hunting preserve is a conditional use in an A-1 zone. The issue is timing. The Planning Commission needs to hear it and the Supervisors need to hold a hearing on it. You’re looking at October before it’s done. We need to speed up the process and still let Dan get the permit. Netzler – there will be no Sunday hunting of game birds but non-game birds can be hunted. Discussion. Attorney George Schroeck arrived at 0845 hours. Miller moved to pass the issue on to the Planning Commission and set a hearing date for 9/29/05. Henderson seconded. Carried. Sachar moved to authorize a letter to be sent to the PA Game Commission about a hunting preserve at 11334 Silverthorn. Henderson seconded. Carried. MINUTES Sachar moved to accept the minutes of 8/9/05 as presented. Henderson seconded. Carried. REPORTS Roadmaster – Dave reported that the crew has quit grading due to lack of brine. Two dry hydrants were installed, some ditching and stump removal was done and some signs were installed. The blacktop on Falls Road was sawed in preparation for cross-pipe installation. Agility, CDL Driving Hours, Anti-Skid Building, Grader Agreement with Washington Township – nothing. Falls Road Bridge #1 – bid opening is advertised for 9/8/05. Bids can be approved at that meeting or on 9/13/05 if time is needed for review. Equipment Repair – the exhaust manifold on the grader needs repaired again. Truck #6’s transmission pops out of 7th gear (will wait on repairs). Henderson – we really need to talk about replacing the trucks. We’re in need of two. The JCB seems to be working fine, on occasion the clutch slips. Dirt and Gravel Road Program Application – word is that applications have come in but no meeting has been held as yet to allocate the funds. Francis Pipe Grant Application – grant application was mailed with a letter of support from Representative Matthew Good. Dry Hydrants – two hydrants were installed. A letter was sent to Marshall Tolley to see if he would consider installing a pond with a dry hydrant on his property. FINANCIAL AND TAXES Bills – Sachar moved to pay the bills as listed totaling $10,668.44 general fund and $1,137.63 permanent improvement fund. Miller seconded. Carried. Payroll – Miller moved to approve payroll #17-05 as presented. Sachar seconded. Carried. Clean and Green Reassessments, Procurement Cards, EMS Tax, Benefits Credits – nothing. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Regional Planning, Storage Trailers, History Grant, Recycling, Ordinance Compliance, Edinboro Watershed – nothing. Industrial Park/KOZ – a meeting will be held at the Governor’s Center for Local Government at 100 State St, Erie on 8/30/05 beginning at 1 p.m. Shooting Range – a letter was received from Joe Weindorf. It appears that no action has been taken by the County toward securing a grant for building the indoor shooting range. Henderson – their priority right now is a 14 million dollar building to be used as a communication center. Sachar – send a copy of Weindorf’s letter to the residents. Nuisance Complaint/Swanson Property on Mohawk – hearing is set for 9/13/05 at 8 p.m. Noise Complaint/Denny’s Bar and Banquet – Dave said that he put a sample noise ordinance from the EPA in the Supervisor’s boxes for review. Dan Koman/Public Assembly Permit – a letter was sent to Mr. Koman in January 2005 reminding him that he needed public assembly permits for various functions held at his Wooden Nickel Buffalo Farm. According to his website, he has two functions coming up that are currently not permitted. On September 3rd a Music Jamboree is scheduled, on October 8th and 9th a Fall Festival is scheduled. Previously held events for 2005 were Baby Bison Days/June 25/26; Native American Festival/July 30/31. Neither event had a public assembly permit. Miller – a music festival would be the one that needs a public assembly permit. There could be a large number of people in attendance, loud music, sewage needs etc. That’s where we had the complaints before. Henderson – if he provided all the bonds and documentation he could do it under one permit. Sachar – sent him another letter saying that he was notified in January that he needed permits. If he does not comply with the Public Assembly Ordinance, he will be shut down. Miller moved to send Dan Koman a letter stating that he is in violation of the Public Assembly Ordinance Section 3E by not filing for a permit 30 days before the date on which the public gathering is proposed to be held. The October Fall Festival can be included in the permit application. Sachar seconded. Carried. SOLICITOR Vittorio Judgments – Henderson moved to authorize service by the constable and to pay the $21.55 service fee. Sachar seconded. Carried.
