November 17, 2005 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0830 hours. Present were Sachar, David Henderson and Tom Graney/Graney and Associates. Jarrett Miller was absent. HEARING: REGIONAL COMPREHENSIVE PLAN No residents were present to comment. The Regional Comprehensive Plan will be adopted by Resolution at the 12/13/05 meeting. Henderson moved to close the hearing, Sachar seconded. Carried. Multi-Municipal Zoning – Tom Graney discussed the possible options available. He felt the easiest method is to adopt the same ordinance framework. A land sharing agreement would not affect Franklin Township much but would Washington Township see it as a loss of sovereignty. A change in land use could be an issue. Mr. Graney felt it would be a tough sell for three municipalities using the same ordinance. A regional Zoning Hearing Board could be established with one administrator. This would reduce the costs to all three municipalities. Discussion. Mr. Graney left the meeting at 0847 hours. MINUTES Sachar moved to approve the minutes of 11/8/05 as presented. Henderson seconded. Carried. REPORTS Roadmaster – Dave reported that the equipment is ready for snow. Lay-off will begin on schedule. Falls Road Bridge #1 – they are swamped with water but are hoping to recover quickly. CDL Driving Hours, Grader Sharing Agreement, Dirt and Gravel Roads Grant Application, Francis Road Grant Application, Elk Creek Boundary Road Agreement – nothing. Improper Verizon Road Bore at 9450 Mohawk Road – Dave said nothing is happening with the needed repairs and the job needs to be done immediately. Henderson moved to authorize our Solicitor to write a letter to Verizon demanding immediate attention to this problem. Sachar seconded. Carried. FINANCIAL AND TAXES Bills – Sachar moved to approve the bill list for payment as presented totaling $3,011.28 general fund and $274.27 state fund. Henderson seconded. Carried. Payroll – Sachar moved to approve payroll #23-05. Henderson seconded. Carried. Clean and Green Reassessments, Procurement Cards – nothing. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Regional Planning, Industrial Park/KOZ, Storage Trailer Amendment, Recycling, Shooting Range, Edinboro Lake Watershed, Wetland Replacement for Airport – nothing. Ordinance Compliance/Zachary Smith, 8244 Crane Road – a violation notice will be sent. History Grant – the printed copies are here and will be distributed. Dave will pick up the DVD at EUP. Pieper Mylar – Larry and Joan Pieper are subdividing 2 acres gross from their property at 7216 Crane Road. Lot will have 290 ft. of frontage. Two acres gross meets the State regulation to leave residue in Clean and Green. Sachar moved to accept the Pieper Mylar as presented. Henderson seconded. Carried. Mylar was signed. SOLICITOR Vittorio – after the thirty-day appeal period is over, we can have the constable post the property. The constable determines the date the property can go up for sheriff sale. Henderson – we have a set amount of judgment and need to proceed in a timely manner. OLD BUSINESS Internet Broadband – no word back from Hugh Crandall as yet. 2006 Tentative Budget – the line item for the Erie Zoo ($1,609) and for DocStar ($2,400) will be eliminated. Discussion on what tax increase will be adopted. The tax collector’s breakdown of the number of residents that would be affected by an Emergency Municipal Services Tax was reviewed. Henderson – close to $6,000 could be raised with an EMST less expenses and the tax collector’s commission at $47 per employee. The Township could net around $5,500. This amount could vary from year to year. Sachar – does this money need to be earmarked? Henderson – the uses allowed are pretty broad. It doesn’t really matter. Sachar – is this preferable to a 1/10th mill real estate increase? Henderson – 1/10th mill is around $7,000 less commission for collection. Most municipalities are already collecting the EMST at one level or another. We could adopt one or both. We need to establish who will collect it and the commission paid; $47 x 127 is $5,969 gross or around $5,560 net less 3% commission and expenses. A 1/10th of a mill increase would gross $7,140 less expenses of 3% commission. We could use the increase as a cash carry forward in the budget. Discussion. Both a real estate tax increase of 1/10th mill and a $47 EMST will be adopted. Sachar moved to advertise the tentative budget for public viewing with adoption scheduled for December 13, 2005.
