January 2, 2007 The organizational meeting of the Supervisors of Franklin Township, held in the Township office, was called to order at 1700 hours with the Pledge of Allegiance. Present were John Sachar, Gary Truitt and David Henderson. ORGANIZATIONAL AGENDA APPOINTMENTS: Temporary Chairman and Temporary Secretary – Truitt moved to appoint John Sachar as temporary chairman and Bonnie Bernhardt as temporary secretary. Henderson seconded. Carried. Chairman – Henderson moved to appoint John Sachar as chairman. Truitt seconded. Carried. Vice Chairman – Henderson moved to appoint Gary Truitt as vice chairman. Truitt seconded. Carried. Secretary-Treasurer; Assistant Secretary-Treasurer – Henderson moved to appoint Bonnie Bernhardt as secretary-treasurer and David Henderson as assistant secretary-treasurer. Truitt seconded. Carried. Vacancy Board – Henderson moved to appoint Paul Sachar to the vacancy board. Truitt seconded. Carried. Solicitor and Special Counsels for various Boards – Henderson moved to appoint Schroeck and Associates as regular Township Solicitor; Steadman Law Firm as Zoning Hearing Board counsel; Elderkin Law Firm and Quinn Law Firm as special counsel. Truitt seconded. Carried. Secretary - Planning Commission and Zoning Hearing Board – Henderson moved to appoint Bonnie Bernhardt as secretary to the Planning Commission and Zoning Hearing Board. Truitt seconded. Carried. Act 511 Tax Collector – Henderson moved to appoint June Shelhamer as Act 511 tax collector. Truitt seconded. Carried. Zoning Administrator – Henderson moved to appoint Bonnie Bernhardt as zoning administrator. Truitt seconded. Carried. Planning Commission – Henderson moved to reappoint whoever’s term is up. Truitt seconded. Carried. Zoning Hearing Board – Henderson moved to reappoint Jim Hull as chairman and Carol Sanders; also to appoint another member and an alternate. Truitt seconded. Carried. Executive Board of the ECATO, delegate and two alternates – Sachar moved to appoint David Henderson as delegate, John Sachar and Gary Truitt as alternates. Henderson seconded. Carried. State Convention Delegate – Sachar moved to appoint David Henderson as state convention delegate. Truitt seconded. Carried. Equipment Operators and Laborer; Temporary Drivers and Substitutes – Henderson moved to approve the laborers, operators, drivers and substitutes as follows: David Henderson, John Sachar, Gary Truitt, Richard Gould, Lawrence Pieper, Robert Schonthaler, Craig Pieper, Ed Dlugolenski, Kevin Hammond, Randy Pertl, Paul Pieper, Joe Johnson, Randi Hammond, George Shimpeno and any others currently working. Carried. Appoint County to collect Real Estate Transfer Tax – Henderson moved to appoint the County of Erie to collect the real estate transfer tax. Sachar seconded. Carried. Appoint Engineer – Sachar moved to appoint Mark J. Corey and Associates as engineer. Henderson seconded. Carried. Appoint Erie County Tax Claim Bureau to collect delinquent real estate taxes – Henderson moved to appoint the Erie County Tax Claim Bureau to collect delinquent real estate tax. Truitt seconded. Carried. Elected Auditors – the elected auditors are Debra Howard Greenleaf/six year term; David Dows/four year term; Judy Sheffer/two year term. All took office January 2006. COMPENSATION AND MILEAGE RATES: Recommend to Auditors – Supervisors wages and benefits according to the Pay and Benefits Schedule – Henderson moved to recommend to the auditors the Pay and Benefits Schedule. Accumulated vacation days or hours can be carried over at the end of the year. Truitt seconded. Carried. Wages and Benefits – laborers, equipment operators, new employees, secretary/treasurer, zoning secretary, and Zoning Hearing Board secretary according to the Pay and Benefits Schedule – Henderson moved to set the wages and benefits for those listed according to the Pay and Benefits Schedule. Accumulated vacation days or hours can be carried over at the end of the year. Truitt seconded. Carried. Act 511 Tax Collector – Henderson moved to pay the 511 tax collector four (4) percent of taxes collected plus expenses. Truitt seconded. Carried. Compensation for selling garbage tags; Shelhamer – Henderson moved to pay June Shelhamer ten (10) cents per tag sold. Truitt seconded. Carried. Solicitors Fees – Henderson moved to pay the solicitors as established at the previously negotiated rates or their hourly rate. Truitt seconded. Carried. Engineer Fees – Henderson moved to pay the engineer fees as established at the previously negotiated rates or their hourly rate. Truitt seconded. Carried. OTHER: Roadmaster Duties – Henderson moved that the Roadmaster duties be as outlined in the Second Class Township Code and as authorized by the Board of Supervisors. Truitt seconded. Carried. Duties – Other Employees – Sachar moved that the other employee’s duties are to be as outlined by the Second Class Township Code and as determined by the Roadmaster and/or the Board of Supervisors. Truitt seconded. Carried. Meeting Dates and Time – Truitt moved to set the monthly meeting dates for the second Tuesday at 7:00 p.m. and the last Wednesday at 8:00 a.m. Budget meetings will be held November 12th and 14th at 8:00 a.m. Meeting will be moved to the FTVFD Social Hall in case of an overflow crowd. The organizational meeting for 2008 will be held on January 7th at 5:00 p.m. Sachar seconded. Carried. Office Hours – Truitt moved to set office hours for Tuesdays and Thursdays from 8:00 a.m. to 2:00 p.m. Sachar seconded. Carried. Set Treasurer Bond Limit, $200,000 – Henderson moved to set the treasurer’s bond limit at $200,000. Truitt seconded. Carried. Depository for Township Funds – Henderson moved to approve PNC Bank and PLGIT as depositories for Township funds. Truitt seconded. Carried. Review Procedures for Selling Garbage Tags and Review Price – Henderson moved to keep the procedures the same and charge $2.50 per regular tag and $1.00 per recycle tag or as increased from time to time by Welka’s Disposal. Truitt seconded. Carried. Review Charges for Ordinances, etc. – Henderson moved to set the fees at $6.50 plus postage and/or costs for ordinances and 10 cents a page for a copy. Research time is set at $6.58 per half hour or part thereof for the first half-hour and $6.58 for each successive half-hour or part thereof in accordance with the Open Records Policy. Review Schedule of Fees for Highway Occupancy Permits – Henderson moved to set the Township’s fees schedule at the prevailing rate per the PA Department of Transportation’s Schedule of Fees: for driveway pipe installation a fee of $250 plus $25 minimum use permit fee plus the cost of the pipe for a standard 20 ft. length will be charged; the cost for installation of each additional 10 ft. length is $125. There will be a charge for an extra load of crushed gravel. Truitt seconded. Carried. Custodian – Petty Cash – Henderson moved to appoint Bonnie Bernhardt as custodian of petty cash. Truitt seconded. Carried. Reenact all fees for various applications, ordinances and fines – Henderson moved to reenact all fees for various applications, ordinances and fines. Research fee is ½ the secretary’s hourly wage per half hour of research time. Truitt seconded. Carried. Reenact fee for Tax Certifications and Memo Bills – Henderson moved that the tax collector is authorized to collect actual out of pocket expenses incurred as follows: $5.00 service charge for providing tax certifications upon request by members of the public; $20.00 or prevailing rate charge for NSF checks that are returned from the bank and charged to the account of the tax collector; $5.00 service charge for “in lieu of” bills or additional duplicate tax bills. Resolution #1- 02 shall apply. Sachar seconded. Carried. REGULAR AGENDA VISITORS/PUBLIC COMMENT No visitors were present. MINUTES Truitt moved to approve the minutes of 12/28/06 as presented. Sachar seconded. Carried. REPORTS Roadmaster – Dave reported that there has been no snow to plow. Agility, Francis Road Pipe Grant Application, Fire Ponds Grant Application, MO4 Dirt and Gravel Roads Program, Anti-Graffiti Paint on Bridges, Roads to Gravel, Funding for 2nd D&G Program – nothing. FINANCIAL AND TAXES Bills – Henderson moved to approve the bill list for payment totaling $6,596.61 general fund and $2,288.00 fire dept. fund. Truitt seconded. Carried. Payroll – no payroll. Procurement Cards – nothing new to report. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes – the Supervisors will meet with the Commission tonight. Joint Comprehensive Plan, Industrial Park/KOZ, Storage Trailer Issue, History Grant, Recycling, Shooting Range, Edinboro Lake Watershed, NIMS Compliance, Flu Pandemic, Dry Hydrant at 8355 Old State, Davis Child-Care Facility – nothing. Stormwater Management Model Ordinance – the State has adopted a “best management practices” manual. Henderson – it is not clear if we will end up with 2 ordinances or one. We already have one for the Lake Erie watershed. We need some advice from E.C. Dept. of Planning. This will affect most construction, even residential. Ordinance Compliance – Steve Chivari stopped in and asked about his storage trailer. He was told that it had to be removed. He said he would come to the Tuesday meeting in February. SOLICITOR Vittorio, Ordinance Rewrite, Girard Gravel Pit – nothing. Brown/Carver Property on Rt. 98 – the Nuisance complaint will be sent. Ordinances with Procedural Defects – Dave asked Attorney Schroeck if we should codify all of our ordinances. If so the company that would be hired to do the work would send the codification back in book form. We would then reenact the whole book. Discussion. Truitt – that would be too expensive. Henderson – we can apply for a grant to pay for the codification. We can work on it after the Zoning and Subdivision Ordinances are updated. Commonwealth Court Ruling on UCC Inspectors – John said that the ruling says you can not mandate an exclusive inspector. Henderson – if this is not appealed, I say we opt out. Let the State do the work. Discussion was held on the PSATS web reflector’s discussions on this issue. OLD BUSINESS Internet Broadband, Verizon FIOS, Elk Creek Boundary Road Agreement – nothing. NEW BUSINESS No new business. CORRESPONDENCE PSATS News Bulletin – discussion was held on the transportation funding crisis within the State and on the State committee’s recommendations to increase EIT collections and the gas tax. Henderson – this proposed increase only makes things hold steady. It does not improve anything. It’s the same with our gravel tax increase; it just pays for holding steady. PA One Call was discussed. Dave said that anytime we go out to ditch more than 18” deep, we have to call PA One Call. Further discussion was held on other news items in the Bulletin.
