March 28, 2007 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0800 hours with the Pledge of Allegiance. Present were Sachar, Gary Truitt, David Henderson, Reporter Audrey Scruton and Attorney David Rhodes. VISITORS/PUBLIC COMMENT No visitors were present. MINUTES Truitt moved to approve the minutes of 3/13/07 as presented. Henderson seconded. Carried. REPORTS Roadmaster – Dave reported that the roads are very soft. Some rotary ditching has been done and some areas with bad potholes will be lightly graded. Grading is taking a real risk; the areas graded may turn to mush. The predicted rain will help but a week of rain would be trouble. The crew is back on part-time, Rick is ditching and Bob is working on the tanker getting it ready for inspection. Agility – we want to seal coat New and Silverthorn 2 this summer. We’re waiting to hear from PennDOT. Anti-Graffiti Paint, Francis Road Pipe, Fire Ponds, Gravel, Tanker Repairs – nothing. Dirt and Gravel Roads Projects – Dave said he is doing more work on each project. A letter will be sent to residents that may be affected concerning ditch banks. We will be cooperating with Greenfield Township for driving surface aggregate for the two projects. They will be bidding on 10,000 tons. We will add in our 600 tons and perhaps get a better price. They will bid in June. We will need the material in July or August. Oshkosh Spreader – the estimated cost for stainless replacement parts is $1,700. Walsh Equipment has mild steel parts on hand for $457. The steel parts are inside parts. The cross arms and ears that we would weld on would be stainless. It was decided to get the steel parts from Walsh Equipment. Sachar – put good epoxy paint on the parts right away. Overweight Permit – Dave Merritt drove a truck crane onto Eureka #4 to Art Foy’s house being unaware that the roads are all posted with a 10-ton weight limit. He now wants to remove the equipment and has asked for permission to do so. Attorney Schroeck prepared documents for him to sign accepting responsibility for any damage done to the road. He would not accept the responsibility and did not sign the agreements. A fine from PSP would be $2,000. He then decided he wants an overweight permit and would get an insurance bond so that the equipment could be removed. He wants Showman and Sons to haul it. The combined weight would be very much over the posted limit. PSP advises that he needs a bond. Henderson – the question is can we refuse to issue a permit knowing that allowing its removal will cause damage to the road. Discussion. Sachar – how many axles? Henderson – two with big tires. Truitt – don’t let Showman on the road with his 17-ton vehicle. Drive it to Crane. Henderson – Crane is 10-ton also. Damage will be sub-surface, not anything immediately visible. We’ll have to ask our Attorney. MC-70 Quote from Russell Standard – their quote is $1.86 a linear foot. Henderson moved to accept the Russell Standard quote for MC-70. Truitt seconded. Carried. It is up to the residents if they want to use it. FINANCIAL AND TAXES Bills – Sachar moved to pay the bill list as presented totaling $4,654.19 general fund. Truitt seconded. Carried. Payroll – Henderson moved to approve payroll #6-07 as presented. Truitt seconded. Carried. Procurement Cards – the cards were received. There is still some paperwork to do before we can start using the system. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Joint Comprehensive Plan, Industrial Park/KOZ, Stormwater Management, Storage Trailers, History Grant, Ordinance Compliance, Shooting Range, Edinboro Lake Watershed, Flu Pandemic, Dry Hydrant on Old State, Elizabeth Davis Child Care Facility, Girard Pit – nothing new to report. Soil Conservation Letter on Wetlands/Subdivisions – the scheduled April training was postponed until sometime in May. Recycle Day – the scheduled day is September 22nd. Dave reported that the Township spent $2,600 on labor only on our last recycle day in 2001. Six hundred was spent the day of the event, $2,000 was spent prior to the day with prep work and pick up of items for our senior citizens. Henderson – we have $1,000 in the budget so we may be shy $500 in labor expenses. Pick up would be only for those seniors who can not take the recyclables themselves. Our older residents participate more than our younger families. Sewage Complaint – the homeowner in question came into the office to say that he is working on the broken sewer line and will make permanent repairs as soon as the area is accessible to equipment. Cable TV Franchise Renewal – Dave said that we need to begin the informal renewal process with Coaxial Cable. There are two processes allowed for renewal. The informal process is between the cable company and the municipality. This can be done anytime within 36 months prior to the renewal date. The formal process is much more burdensome to both parties. Henderson – do we want to go through the informal or formal process? There may be more ramifications to the process than we are aware of. We need to do something by June 13th. The previous agreement was for 15 years. We should probably renew for only 5/7 years. We will ask the cable company’s attorney to come to the April 10th meeting. SOLICITOR Vittorio – no money has been received. Nuisance Ordinance Rewrite – the draft will be forwarded to our Attorney. UCC Inspectors – nothing new to report. Brown/Carver Property – Attorney Rhodes said that he sent a draft agreement to Attorney Schroeck who made a change concerning the mobile home. Rhodes - it was my understanding that it either had to be removed or made fit for habitation and inhabited. The change says only that it must be removed. My concern is that if you remove the incentive of fixing it up, they won’t do anything with it. Our hope is, make it easier for them to fix it up. There is no signed agreement because of this change. Sachar and Truitt – your recollection is correct. Rhodes – if that is alright, have your Attorney make the correction and we’ll get a signed agreement. Discussion. Attorney Rhodes left the meeting at 0818 hours. OLD BUSINESS Internet Broadband, Verizon FIOS – nothing. Boundary Road Agreement with Elk Creek Township – no word has been received from them.
