July 10, 2007 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 1900 hours with the Pledge of Allegiance. Present were Sachar, Gary Truitt, David Henderson, Carol Loll/County Council, Reporter Courtney Soder and Denise Benedict. VISITORS/PUBLIC COMMENT No comments. MINUTES Truitt moved to approve the minutes of 6/27/07 as presented. Henderson seconded. Carried. REPORTS Roadmaster – see below. Agility – nothing. Francis Road Pipe, Fire Ponds – will reapply for the next grant round. Gravel – graveling will start August 6th. Dirt and Gravel Roads Projects – Dave reported that the crew has been working on the SI5 and MO4 projects. There is a spring under the road on Mohawk. It needs an under-drain installed. This project is waiting for fabric and seeding. Silverthorn is ready for fabric. Most work should be done by the end of the week. Rep. Hornaman Grant – no paperwork has been received. The funds need to be in this year’s budget. Bond for Driveway Permits – we’ll contact Fairview Twp. to see how they handle driveway permits. FINANCIAL AND TAXES Bills – discussion on various bills. Truitt moved to approve the bill list for payment totaling $1,494.18 general fund; $5,666.62 state fund; $983.63 equipment fund and $2,517.63 permanent improvement fund. Henderson seconded. Carried. Payroll – Henderson moved to approve payroll #14-07 as presented. Truitt seconded. Carried. Mid-Year Budget – Dave presented a mid-year budget that shows an expected increase in revenue of $38,815 and an increase in expenses of $47,374 due in part to unbudgeted equipment repairs. Henderson – labor for the Mohawk project is $7,000 and it was not budgeted. This is the second D&G grant that we received after the budget was approved. We will lay off the crew earlier than normal. We are way over budget on maintenance, primarily for the tanker, 1-ton and Oshkosh. The $5,000 grant from Rep. Hornaman will offset some of the expense. We also had an increase in worker’s comp that they did not tell us about at budget time. We need $10,000. That amounts to a 3-week lay-off. We will lay-off when Rick goes on vacation the last two weeks of July. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes – reviewed. Update Comprehensive Plan – the letter from Tom Graney was reviewed. Henderson – the costs listed are at full cost. A LUPTAP grant would pay for half and there would be a cost savings if the County would do the maps. We will apply for a grant this year and budget it for next year. Discussion. We can use the conditional use process for Growing Greener for those interested and not force it on everyone. We need to pass this off to the Planning Commission for any comments they may have. They will be doing a lot of the work involved. Sachar – do we need to choose an option before we apply? Answer – yes. Industrial Park, Stormwater Ordinance, Storage Trailers, History Grant, Edinboro Lake Watershed, Dry Hydrant, Ordinance Compliance – nothing. SCD Letter on Wetlands/Subdivisions – Dave reported that ECATO has taken up the issue and wants guidance from the Northwest Commission. Recycle Day – one west county municipality dropped out so the cost will be a little higher for the rest. Dave reported that we would still be within budget. Discussion was held on soliciting Twp. businesses for a donation. If unsuccessful, the purchase of 2 $50 gas cards will be authorized. Henderson – the flyer that we send out will ask for volunteers. It will also include the County’s e-recycle information. Shooting Range – Carol Loll stated that this issue needs to be pushed. The noise level has increased considerably. Henderson – a noise ordinance is not applicable. Loll – I will contact Joe Weindorf again. He has blocks donated for the building. He has been extremely busy with the new 911 building but this issue needs to be pushed also. Henderson – we have not had a response on early notification from Mercyhurst. Elizabeth Davis Home Child Care Facility – Mrs. Davis is working on her certifications. Cable TV Franchise Renewal – a letter will be formulated with our position. MNO/Gehr Property on West Stancliff – no response received to our letter. RESOLUTION #6-2007 A resolution to approve, adopt and place immediately into effect the Erie County Hazard Mitigation Plan. (see file for complete resolution) Adopted this 10th day of July, 2007. Henderson moved to adopt Resolution #6-07 as presented. Truitt seconded. Carried. Resolution was signed. Steve Chivari arrived at 1937 hours. Henderson – winter storms are our most likely hazard followed by a hazardous chemical spill on I-79. SOLICITOR Vittorio, Nuisance Ordinance Rewrite, Brown/Carver Property, Ruling on UCC Inspectors – nothing. Chivari Storage Trailers and Assessment Steve Chivari – I talked to someone today to haul the trailer away as soon as it is unloaded. It will be the last week in July when I will unload it. It will be gone by the 10th of August, 2007. Henderson – we will instruct our Solicitor to suspend the filing. Chivari – what was the question with the additions? Henderson – the additions were put on with no building permits. Chivari – the County assessment did not take in the additions. Those out- sections were built by my dad at least 20 years ago, in the late 80’s or so. Permits weren’t needed at that time. Henderson – no building permits were issued for those other trailers. None of those were permitted. Chivari – I plan on tearing those out of there also. Sachar – does he need a permit to remove them? Henderson – yes, the permit serves to take them off his assessment. Chivari – since my property is used as commercial, how do I change it to commercial zoning? Henderson – your taxes will triple if you do that. An airport is a conditional use in an A-1 zone. You have a conditional use; it was there when the zoning ordinance went into affect. Merritt Crane Overweight Violation – Mr. Merritt sold the crane before it was moved. The purchaser agreed to pay the fine, moved it out and didn’t pay the fine. The issue will be turned over to our Solicitor. OLD BUSINESS Internet Broadband, Verizon FIOS, Elk Creek Boundary Road Agreement – nothing. NEW BUSINESS ECAB Picnic – Henderson will attend the July 18th picnic held at the McKean Recreation Park. CORRESPONDENCE Erie County 12-Year Transportation Plan – the Carbury Road bridge is in the last 4 years of the plan. Henderson – it stays in the last 4 year period until we say move it up, probably in 10-15 years. Unless we get grant money, the Francis Road pipe will cost in the $150,000 range. If it collapses we will have to close the road. Henderson – my plan was a 5 ft. plastic pipe with 2 smaller pipes beside it. The pipe drains around 400 acres. We would need a hydraulic study done to come up with a final cost. Discussion. NAT&T Convention – no one will attend. ADJOURN Sachar moved to adjourn, Henderson seconded.
