September 26, 2007 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0806 hours with the Pledge of Allegiance. Present were Sachar, Gary Truitt, David Henderson, Reporter Courtney Soder and Joanne Markham. VISITORS/PUBLIC COMMENT No comments. MINUTES Truitt moved to approve the minutes of 9/11/07 as presented. Henderson seconded. Carried. REPORTS Roadmaster – Dave reported that the crew is repairing equipment today. Agility – PennDOT completed the seal coat on SI2 and NE3. Good job. Francis Road Pipe – waiting for Mark Corey. Fire Ponds Grant Applications – applications were updated and signed by Chairman Sachar. Rep. Hornaman’s office will shepherd the applications through the process. Dirt and Gravel Road Program Grants – Dave reported that both jobs are finished. There may be some roller work done on both to help compact the material more. Henderson – the compaction problem may be because it wasn’t compacted enough the first time. If it sets up after a good rain storm, that’s good. If not, we’ll have to look into it. Both project’s dollars and cents are in line and we will claim the other half of the grant funds when the final bills come in. Rep. Hornaman Grant – Dave reported that he ordered several items that were included in the grant. We are waiting for the funds to be received. Repairs to Oshkosh – John said he would look at it. Washington Township Roller – nothing. FINANCIAL AND TAXES Bills – Henderson moved to approve the bill list for payment totaling $8,821.58 general fund; $2,966.29 state fund and $21,666.96 gravel fund. Truitt seconded. Carried. Payroll – Henderson moved to approve payroll #19-07 as presented. Truitt seconded. Carried. Tax Collector/State Tax Convention Expenses – Henderson moved to authorize the tax collector to attend her State Convention and to pay her expenses. Truitt seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Stormwater Management, Storage Trailers, History Grant, SCD Letter on Wetlands, Ordinance Compliance, Shooting Range, Edinboro Lake Watershed, Davis Home Child Care, Cable TV Franchise, Public Safety Road Naming – nothing. Joint Comprehensive Plan – Tom Graney sent paperwork to apply for a LUPTAP grant to update the SALDO; $6,000 DCED and $6,000 Township match. RESOLUTION #7 OF 2007 Authorization to file a LUPTAP Grant Application WHEREAS, in 2005, the Borough of Edinboro, Franklin Township, and Washington Township prepared and adopted a multi-municipal comprehensive plan; and WHEREAS, on page 36 of said plan, the adopted policy stated: “Franklin’s SALDO is sound, although the Township should review the land development section. Its zoning ordinance is dated and should be replaced”; and WHEREAS, after due consideration, the Township desired to implement that recommendation by revising its SALDO and adopting a new zoning regulation; and WHEREAS, such implementation activities are clearly eligible for grant assistance under the Land Use Planning and Technical Assistance Program of the Pennsylvania Department of Community and Economic Development. NOW, THEREFORE, BE IT RESOLVED by the Board of Township Supervisors of Franklin Township that: 1. The Township hereby authorizes the filing of an application for grant assistance to the Pennsylvania Department of Community and Economic Development. 2. The appropriate officials are hereby authorized and directed to execute such documents as are needed to file such an application. 3. The Township will provide up to $6,000 in matching funds. Henderson moved to adopt Resolution #7-07 as presented. Truitt seconded. Motion carried unanimously. Resolution was signed. Industrial Park/KOZ – Dave reported that he has a call in to Rick Novotny. They will seek to approach the new president of EUP about the KOZ. Recycle Day Preliminary Report – 82 households from F.T. participated and brought 273 tires, 23 Freon units and lots of other items. The event was well organized and very successful. Dry Hydrants – letters were sent. Refusal of County Assessment Office to Accept Township’s Official Address Corrections – Henderson stated that we need to address and solve this issue. The Second Class Township Code gives us the authority to set and change addresses. Truitt moved to authorize addressing this issue. Henderson seconded. Carried. Gaming Funds Press Conference – press conference is 9/27/07 beginning at 2 p.m. at Greene Township. SOLICITOR Vittorio, Nuisance Ordinance, Brown/Carver, Court Decision/UCC Inspectors, Merritt Truck Crane Weight Violation, Court Decision/Airports – nothing. OLD BUSINESS Internet Broadband, Verizon FIOS – nothing. Elk Creek Boundary Road Agreement – their letter was reviewed. They wish to go back to the previous agreement/they plow their roads, we plow ours. Sachar – this is inconvenient. Do you know why they want to do this? Henderson – it was their idea in the first place to change the agreement. I’m baffled by this letter. They mention weight limits, if you are in charge of the signs on a road; you’re responsible for any weight limits and bonding. It goes by who does the summer maintenance, if you do the summer maintenance then you also do the signs. Signs/traffic control devices includes all signs. The old agreement is so convoluted and out of date that it is useless. We need a good agreement for snowplowing. We need to meet with their Board. I’ll set it up. NEW BUSINESS Sewage Regulations coming from DEP – new regulations will force all systems to be managed with regular inspections, both old and new. If needed the systems must be replaced or updated. Supervisors must sign a statement assuring the maintenance of all individual systems. Henderson – DEP wants townships to be managers of all on-lot systems or install public sewer systems. The law already mandates us to be responsible. Erie County is only one of six counties that have a Health Department that manages septic systems but we are still responsible. We could end up being forced to put in a sanitary sewer system. It is far more economically responsible to keep your on-lot systems in good working order. This paperwork process could take several years before it becomes mandated. Truitt – we should make our residents aware that this is coming. Can you put in a new leach field without a permit? Henderson – we can check with the Health Dept. In some locations, there are mandatory pumping schedules, once every 3/5 years. CORRESPONDENCE None.
