October 31, 2007 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0806 hours with the Pledge of Allegiance. Present were Sachar, David Henderson, Reporter Courtney Soder and Joanne Markham. Gary Truitt was absent for a family emergency. Chairman Sachar announced that two executive sessions were held between the October 9th meeting and this meeting to discuss personnel issues. VISITORS/PUBLIC COMMENT No comments. MINUTES Henderson moved to accept the minute of 10/9/07 as presented. Sachar seconded. Carried. REPORTS Roadmaster – Dave reported that the last round of grading for the fall is about half done then the equipment will be prepared for snow. Stolen Signs – the set of road name signs at Gudgeonville and Old State was stolen again for the third time. The pole had mower damage. PSP contacted the land owner who said that Tim Buren mows for her. Mr. Buren contacted the Township and said he hit the post once knocking it down and someone stole the signs while they were down in the time it took him to make one round of mowing. He admitted to hitting the sign post only once. The post has been hit at least three times. Sachar – will he reimburse us for it? Henderson – I can call PSP and ask. He says he did not steal the signs. The signs were pried off of the post and that is not an easy or quick thing to do. Discussion. Agility, Grants for Fire Ponds, Hornaman Grant – nothing. Francis and Eureka Pipes – we’re waiting for a cost estimate from Engineer Mark Corey. Both need to be replaced. Henderson – the pipe on Eureka south of Old State; the bottom is gone and water is running beneath it. The pipe is 12 ft. wide and 9 ft. high. Sachar – it was installed around 1982. It seems like we could buy the bottom plate instead of the whole thing and put concrete in the bottom. Discussion. Dirt and Gravel Roads Program Grants – final project report was submitted to the Board. We’re waiting for final reimbursement. Oshkosh and Grader Repairs – both need worked on. Carbury Road Bridge – Dave reported that he checked and the bridge is in the past bridge bill so that requirement has been met. FINANCIAL AND TAXES Bills – Henderson moved to pay the bills as listed totaling $9,248.88 general fund; $1,989.49 state fund; $1,382.28 municipal building fund. Sachar seconded. Carried. Payroll – Henderson moved to approve payroll #21-07 and #22-07 as presented. Sachar seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Joint Comprehensive Plan, History Grant, SCD Letter on Wetland/Subdivisions, Shooting Range, Edinboro Lake Watershed, Elizabeth Davis Home Child Care, Cable TV Franchise, County Road Naming and Addressing Guide, Junk Vehicle Letter/Daniels, Assessment Office/Address Changes – nothing new to report. Industrial Park/KOZ – a letter was sent to Dr. Brown at EUP requesting a meeting, waiting for a reply. Stormwater Management – the County is taking up this issue, Phase I Act 167 Stormwater Plan for Erie County, and is looking for a representative from the Township to attend future meetings. We will ask Dennis Howard if he is interested. Ordinance Compliance – Board drive-by will be November 4th. Safety Improvements at Crane and Route 98 – Dave reported that he talked with Bill Pettit and Randy Brink of PennDOT at the ECATO convention. Mr. Pettit said that PennDOT has been using rubble strips in some places. We will write a letter of request for these to be used at the Crane and Rt. 98 intersection. SOLICITOR Vittorio – we received Mr. Vittorio’s first payment of $112.07 from the Chapter 13 Trustee. The question is, is this a weekly or monthly payment. Nuisance Ordinance Rewrite, Brown/Carver Property, UCC Inspectors, Merritt Weight Limit Violation, Supreme Court Decision on Airports – nothing. OLD BUSINESS Internet Broadband – DSL is coming to some parts of the Township soon. Verizon FIOS – nothing. Elk Creek Boundary Road Agreement – Board will attend their township meeting on November 5th at 7:30 p.m. Henderson – I’m not sure which agreement they want to go back to, the most recently signed agreement or the earlier one. Their roadmaster and I are on the same page for plowing snow. NEW BUSINESS Ordinance #1-2007/Local Services Tax – Dave said that this ordinance repeals the Occupational Privilege Tax Ordinance and the Emergency and Municipal Services Tax Ordinance and replaces it with the new Local Services Tax Ordinance. The new Ordinance maintains the fifty-two dollar ($52) tax limit. The major change is the rate of deduction from a person’s wage. It will be paid to the Township on a quarterly basis. Everyone gets an under $12,000 earnings exemption. Henderson moved to approve Ordinance #1 of 2007 for advertising with the hearing set for the November 28th meeting at 8:00 a.m. Sachar seconded.
