November 28, 2007 The meeting of the Supervisors of Franklin Township, held in the Township office, was called to order by Chairman John Sachar at 0800 hours with the Pledge of Allegiance. Present were Sachar, Gary Truitt, David Henderson, Reporter Courtney Soder, Joanne Markham and Joe and Pam Kochera. HEARING: ORDINANCE #1 OF 2007, LOCAL SERVICES TAX/0800 HOURS Chairman Sachar explained what the ordinance was about and asked for comments from those present. No comments. Hearing adjourned at 0804 hours. VISITORS/PUBLIC COMMENT Joe Kochera explained that he had received a letter about “junk” on his property on Old State. He presented a letter detailing his plans on cleaning up his land and asked if the plans were acceptable. Sachar – we appreciate your response to our letter and will forgo the deadline and accept your plan for clean-up as long as you continue to make progress. MINUTES Truitt moved to approve the minutes of 11/12/07 and 11/13/07 as presented. Henderson seconded. Carried. REPORTS Roadmaster – Dave reported that final prep for winter was completed and the crew went on lay-off at the end of the day on 11/20/07. Agility, Francis Road Pipe, Hornaman Grant – nothing. Fire Ponds Grants – Dave reported that he did prep work for the Tolley pond. Dirt and Gravel Roads – Dave said we will submit an application for 2008. Oshkosh, Grader Repairs – John repaired the grader and will look at the Oshkosh. The Kocheras left the meeting at 0815 hours. Attorney George Schroeck arrived at 0815 hours. FINANCIAL AND TAXES Bills – Henderson moved to approve the bill list for payment totaling $6,473.15 general fund and $1,279.94 state fund. Sachar seconded. Carried. Payroll – Henderson moved to approve payroll #24-07 as presented. Truitt seconded. Carried. Ordinance #1 of 2007/Local Services Tax Henderson moved to adopt Ordinance #1 of 2007 as advertised. Truitt seconded. Carried. PLANNING, ZONING, RECREATION, SAFETY, SANITATION/RECYCLING, HEALTH AND THE COMMON GOOD Planning Commission Minutes, Industrial Park/KOZ, History Grant, SCD Letter on Wetlands, Shooting Range, Edinboro Lake Watershed, Elizabeth Davis Home Child Care, Cable TV Franchise, Address Corrections, Junk Vehicles on Daniels Property – nothing. Zoning Ordinance Rewrite – the LUPTAP paperwork was mailed to Tom Graney who will forward it to DCED. Ordinance Compliance – several who received letters contacted the Township; Mr. Quick said the storage trailers were removed; Mr. Patterson is actively looking for someone to take the junk vehicles on his property; Mr. Sprickman said he would remove the sign; Mr. Pekelnicky said he would remove the vehicles and accumulated parts. Truitt – what about Vittorio? Henderson to Schroeck – Vittorio assumed ownership of the trailers on his property; Keener abandoned the mobile home which is no longer on the tax rolls. He is now using them for his own benefit. The County sees them as still belonging to Mrs. Keener. What should we do? Discussion was held. Truitt – the back of the mobile home is coming apart, the studs are visible. It’s not habitable. Further discussion. Sachar – contact our local scrap dealer and see what the cost is for having it removed and/or scrapped out. We’ll discuss it again at the next meeting. Truitt – send him a letter with a deadline for removal. Truitt moved to authorize the Attorney to draft and send a letter to Mr. Vittorio giving him six (6) months or until June 15, 2008 to removed the mobile home, camper trailers and other “junk” from the property. Henderson seconded. Carried. Addressing Guide – a second draft was received. Henderson and Bernhardt will attend a meeting to discuss it on 12/4/07. Intersection of Rt. 98 and Crane/Rumble Strips – John said that he saw rumble strips in use in Warren County. Dave said that we will request PennDOT do a study on their use at that intersection. SOLICITOR Vittorio – discussion was held on the single payment that has been received. Brown/Carver Property, Court Ruling on UCC Inspectors – nothing. Merritt Truck Crane Weight Violation – Solicitor will move this issue forward. Court Ruling on Airports – Solicitor will send us an opinion letter on this issue. Inter-Municipal Cooperative Agreement with Washington Township – the agreement concerns snow-plowing for the 2007/2008 season. Henderson – their attorney made a few changes to the draft. Changes were reviewed. Truitt – will they use our trucks on their roads? Henderson – as back-up. It’s an additional incentive for them to agree to the arrangement. Schroeck – it looks fine to me. Truitt moved to adopt the inter-municipal cooperative agreement with Washington Township. Henderson seconded. Carried. Henderson moved to authorize the treasurer to issue a check for $5,000 for the first payment ($5,000 in 2007, $10,000 by March, 2008). Truitt seconded. Carried. Terminate Girard Pit Lease with Advantage Topsoil – a letter will be sent to Mr. Summerville. Dave said that he has reimbursed the Township for the permit and bond expense each year but there has been no action at the pit for years. John said that not using the pit is not fair to the Pustelak family who owns the land. OLD BUSINESS Internet Broadband – nothing. Adopt 2008 Budget – adoption scheduled for 12/11/07 meeting.
